Truck Hits Man in Wheelchair in El Cajon

By San Diego Car Accident Lawyer on July 31, 2012 - Comments off

A man in a wheelchair was hit by a pickup truck on July 23, 2012, around 8:30 p.m. in the 1200 block of Persimmon Ave. in El Cajon. According to California Highway Patrol (CHP) officials, the victim was immediately transported to a local hospital for medical treatment.
CHP officials are investigating this serious truck accident that left one person injured. We wish the injured victim all the best for a speedy and full recovery.
From the available information, it seems that the man in the wheelchair was in the crosswalk when this accident occurred and the truck driver violated the right-of-the-way to the man in the wheelchair. Motorists are required under the law to yield the right-of-way to pedestrians in marked or unmarked crosswalks. Under California Vehicle Code Section 21950(a), “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection….”.
According to California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS), pedestrian accidents contributed to 25 fatalities and 575 people were injured. Countywide, pedestrian accidents caused 57 fatalities and injured 937 people, during the same year.
In cases, such as this particular one, the injured victim can seek compensation from the at-fault truck driver to cover medical expenses, cost of hospitalization, loss of earnings, and other accident-related damages. The injured victim would be well-advised to consult with an experienced personal injury accident lawyer who would carefully analyze all the facts pertaining to the accident and assure that the at-fault motorist is apprehended and brought to justice.

Pedestrian Hit by Car While Crossing Street in Rolando

By San Diego Car Accident Lawyer on July 10, 2012 - Comments off

A female pedestrian was struck and injured by a car in the Rolando area on July 3 around 9:45 p.m. on University Ave. at 58th street in Rolando. According to police, the woman was not using a crosswalk.
The injured pedestrian was immediately transported to a nearby hospital for treatment. Based upon a reading of Section 21950, it is quite possible that both the driver and pedestrian may be responsible for this accident. Further, because the pedestrian may not be 100% at fault nor the driver 100% fault-free under their responsibilities set forth by California law, the family of the pedestrian may still be able to recover damages for the loss of their loved one in this accident.
According to U.S. National Highway Traffic Safety Administration statistics, in the year 2009, pedestrian deaths accounted for 12% of all traffic fatalities in motor vehicle accidents.
In this Rolando auto accident, if it is determined that the car driver was at fault, then he may be held liable for the injuries suffered and the damages done. The injured victim can file a personal injury claim seeking compensation for damages including hospital and rehabilitation expenses.
If you or someone you love has suffered losses in a car crash due to someone’s negligence, you are entitled to compensation. Call a Southern California pedestrian crash lawyer at the Jurewitz Law Group at (888) 233-5020 for a complimentary consultation and learn about what rights you have.
