Pedestrian Struck by Bus in Sherman Heights

By San Diego Car Accident Lawyer on August 2, 2012 - Comments off

A pedestrian was struck by a bus on July 25 around 10:30 p.m. at the intersection of 19th Street and Imperial Avenue in Sherman Heights. According to the information provided, it is believed that the bus was traveling from Mexico to El Paso, Texas and was very close to getting on the freeway. Paramedics responding to this serious pedestrian accident transported the injured victim to UCSD Medical Center for immediate medical attention.
Investigating officers will need to determine whether the bus driver was speeding or negligent or if the pedestrian was at fault. Although it is believed that the pedestrian jaywalked across the street, more investigation will have to be done to determine who the at-fault party really was.
According to California Highway Patrol, 18 pedestrians were killed and 494 suffered injuries in pedestrian accidents in San Diego.
Under California Law, it is quite possible that both the driver and pedestrian may be responsible for this Sherman Heights pedestrian accident. If the bus driver saw or could have seen the pedestrian, this accident could have been prevented. Further, because both pedestrian and bus driver may have a percentage of fault for the accident under the responsibilities set forth by California law, damages may still be able to be found for the pedestrian.
The injured victim’s family members should immediately get in touch with an experienced San Diego auto accident attorney who deals in pedestrian accidents to obtain compensation and bring the at-fault party to justice.
In this case, the accident victim can seek compensation to cover medical expenses, loss of wages, cost of hospitalization, rehabilitation, pain and suffering, and other related damages.

San Diego County Bus Accident Leaves Seven Injured

By San Diego Car Accident Lawyer on September 1, 2010 - Comments off

A North County Transit District bus driver and six passengers sustained injuries when their bus collided with a pickup truck on the afternoon of August 28, 2010. According to Valley Center authorities this accident occurred around 2p.m. on North Lake Wohlford Road south of Valley Center.

The southbound pick up truck crossed into the northbound lanes and struck the district bus. Sgt. Scott Payson said that the left front end of the truck hit the left front of the bus and caused moderate damage to both the vehicles. The pickup driver fortunately escaped unhurt, but the bus driver along with his passengers suffered injuries. The injured were taken to a nearby hospital for medical treatment of their injuries.
The windshield of the bus shattered and some of the passengers complained of back and neck pain. Investigating officers are trying to determine why the pickup driver entered into the wrong lane on a straight stretch of road. Payson said that drugs and alcohol do not appear to be the reason behind this crash, but distraction due to cell phone cannot be ruled out. A right-of-way violation may have played a part in this traffic collision. California law requires drivers to give the right of way to oncoming vehicles and to cars who have already entered the intersection from a different road.
If this accident occurred due to the negligence of either or both of the drivers, then the responsible persons might be liable to pay legal compensation to the injured passengers for medical costs and other related deamages.
